URGENT UPDATE: The Trump administration has just filed an emergency request with the Supreme Court to reverse a lower court order blocking the deployment of the National Guard in Chicago, Illinois. This decisive move comes as tensions rise amid escalating violence in the city.

In a filing made on October 9, Solicitor General John Sauer claimed, “This Court should stay the district court’s injunction in its entirety.” He emphasized that the order “impinges on the President’s authority and needlessly endangers federal personnel and property.” The administration argues that immediate Supreme Court intervention is necessary to allow the National Guard to fulfill its protective duties while further litigation unfolds.

The 7th Circuit Court of Appeals recently ruled against the Trump administration, stating that deploying National Guard troops in Illinois likely violates the Tenth Amendment, which reserves certain powers for the states. A three-judge panel, which includes appointees from former Presidents Trump, George W. Bush, and Barack Obama, found insufficient evidence of any “rebellion” against U.S. authority or necessity for military intervention.

The panel’s decision, issued earlier this week, means the temporary restraining order preventing the Guard’s deployment remains in effect until October 23. A hearing is set for October 22 to determine if this order will be extended.

Currently, approximately 200 federalized National Guard troops from Texas and 14 from California are stationed in Illinois, with an additional 300 Guardsmen from Illinois mobilized despite objections from Governor JB Pritzker. President Donald Trump insists that these troops are essential for crime prevention in what he has labeled a “war zone.”
