Federal Judge Rules Trump’s Use of Troops in LA Unlawful

UPDATE: A federal judge has just declared the Trump administration’s deployment of federal troops in Los Angeles for law enforcement operations as unlawful. U.S. District Judge Charles Breyer delivered this ruling on Tuesday, prohibiting troops from engaging in security patrols, crowd control, and arrests.

This ruling is set to take effect on September 12, allowing the Trump administration time to appeal. Breyer emphasized that the use of federal troops essentially created a “national police force with the president as its chief,” violating the Posse Comitatus Act, which limits military involvement in civilian law enforcement.

In his decision, Breyer noted, “The evidence at trial established that Defendants systematically used armed soldiers and military vehicles to set up protective perimeters and engage in crowd control.” This behavior, he argued, constitutes a violation of established law that restricts military authority over civilian matters.

The Posse Comitatus Act of 1878 strictly prohibits military involvement in domestic law enforcement unless authorized by Congress or under specific constitutional conditions. An exception exists under the Insurrection Act, which allows the president to mobilize military forces during severe disruptions; however, Breyer found no justification for such measures in this instance.

This pivotal ruling comes amid ongoing tensions surrounding federal troop deployments in various cities. The implications are significant as communities across the nation grapple with issues of policing and federal intervention.

As this is a developing story, further updates are expected. Stay tuned for more information as the situation unfolds.
